§ 1 Information about the processing of personal data

We delete the data arising in this context if the request is assigned to a contract, according to the periods for the contract term. Otherwise, we delete the data arising after storage is no longer necessary, at most after three years after the data arises at the end of the general limitation period or restrict processing if legal retention obligations exist.
4) If we use commissioned service providers for individual functions of our offer or want to use your data for advertising purposes, we will always carefully select and monitor these service providers and inform you in detail below about the respective processes. We also state the defined criteria for storage duration. If our service providers or partners are located in a state outside the European Economic Area (EEA), we will inform you about the consequences in the description of the offer.
§ 2 Your rights
(1) You have the following rights vis-à-vis the controller with regard to personal data concerning you:
- Right to information

- Right to restriction of processing
- Right to object to processing
- Right to data portability

(2) You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us.
§ 3 Processing of personal data when using our mobile app
1) When downloading the mobile app, the necessary information is transmitted to the app store, in particular username, e-mail address and customer number of your account, time of download, payment information and the individual device identifier. The app store also collects various data independently and provides you with analysis results. We have no influence on this data processing and are not responsible for it. We only process the data insofar as it is necessary for downloading the mobile app to your mobile device.
You can also download this mobile app free of charge directly to your mobile device via our website. In the case of download, additional user data is processed via the website, about which we inform you in the privacy policy of our website https://lifelyfamily.com/datenschutzerklaerung
2) When using the mobile app, we process the personal data described below to enable comfortable use of the functions. If you want to use our mobile app, we process the following data that are technically necessary for us to offer you the functions of our mobile app and to ensure stability and security, so that they must be processed by us.
The legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR:
- IP address
- Date and time of the request
- Time zone difference to Greenwich Mean Time (GMT)
- Content of the request (visited page)
- Access status/HTTP status code
- Amount of data transferred each time
- Previously visited page
- Browser
- Operating system
- Language and version of the browser software.
(3) Furthermore, we need your device identification, unique number of the end device (IMEI = International Mobile Equipment Identity), unique number of the network subscriber (IMSI = International Mobile Subscriber Identity), mobile phone number (MSISDN), MAC address for WLAN use, name of your mobile device, e-mail address for the provision of the services of the app.
§ 4 Processing of data from your devices (so-called "cookie policy")
1) In addition to the data mentioned above, technical aids for various functions are used when you use our mobile app, which can be stored on your device. The technical aids are in particular cookies, but can also be other means, such as AdvertisingID or Authentication-Cache. When calling up our mobile app and at any time later, you have the choice whether to generally allow the use of individual or all voluntary additional functions. You can make changes in the settings of the mobile app or via our consent manager. Below we first describe the technical functions (2), before we go into your individual selection options by describing technically necessary functions (3) and functions that you can voluntarily opt in or out of (4). We describe the functions we use below, which you can select individually via the consent manager and revoke again.
2) We use technical functions with which further services are provided to you, mainly cookies. Cookies are text files or information in a database that are stored on your hard disk and assigned to the browser you are using, so that certain information can flow to the place that sets the cookie. Cookies cannot execute programs or transmit viruses to your computer, but
primarily serve to make the internet offer faster and more user-friendly and to recognize you on a later visit. You can view the cookies set and their lifetimes at any time in the settings of your mobile app and delete the cookies manually.
This mobile app uses the following types of cookies:
- Transient cookies, in particular session cookies, are automatically deleted when the browser is closed or by logging out. They contain a so-called session ID and allow various requests from your browser to be assigned to the common session.
- Persistent cookies are automatically deleted after a predetermined period, which is set differently depending on the cookie.
- Further technologies are not based on cookies, but on similar technical mechanisms, such as an analysis of your browser settings, AdvertisingID, Authentication-Cache or HTML5 objects.
3) Mandatory functions necessary for the function of the mobile app: The technical structure of the mobile app requires us to use techniques, in particular cookies. Without these techniques, our mobile app cannot be displayed (completely correctly) or support functions cannot be enabled. These are basically transient cookies that are deleted after the end of the usage process. You cannot opt out of these cookies if you want to use our app. The legal basis for this processing is Art. 6 para. 1 sentence 1 lit. f GDPR.
4) Optional functions: We only use various cookies or other techniques with your consent, which you can select via the consent manager. The functions are only activated in the event of your consent and can in particular serve to ensure that we can analyze and improve visits to our mobile app, make it easier for you to operate across different browsers or devices, recognize you on a visit or display advertising (possibly also to orient advertising to interests, measure the effectiveness of advertisements or show interest-oriented advertising). The legal basis for this processing is Art. 6 para. 1 sentence 1 lit. a GDPR. You can revoke your consent at any time, without affecting the legality of the processing until the revocation.
5) In iOS you have various options to largely restrict advertising and tracking. The tracking basically runs via the so-called "Advertising Identifier" (IDFA). This is a unique, but not personalized and not permanent identification number for a specific end device, which is provided by iOS. The data collected via the IDFA is not linked to other device-related information. We use the IDFA to provide you with personalized advertising and to evaluate your usage.
If you call up the "Privacy & Security" option in the iOS settings, you can largely deactivate advertising evaluation under "Tracking". If you activate the function "Allow apps to request tracking", our app will ask you during the first use whether you agree to advertising measures and you can activate or deactivate the advertising. In addition, you can select the "Apple Advertising" option in the "Privacy & Security" option and deactivate "Personalized Advertising". In the "Analytics & Improvements" option, you can also deactivate the "Share iPhone Analytics" function and "Improve Siri & Dictation", which means that no statistical information about your use of iOS is transmitted to Apple.
§ 5 Objection or revocation against the processing of your data
1) If you have given consent to the processing of your data, you can revoke this at any time. Such a revocation affects the legality of the processing of your personal data after you have expressed it to us. The legality of the processing of your data up to the point of your revocation remains unaffected.
2) Insofar as we base the processing of your personal data on the balancing of interests, you can object to the processing. This is the case if the processing is in particular not necessary for the fulfillment of a contract with you, which we describe in each case in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as carried out by us. We will then check the situation and either adjust the data processing, stop it or show you our compelling legitimate reasons on the basis of which we continue the processing.
3) Of course, you can object to the processing of your personal data for advertising purposes and data analysis at any time. You can best exercise your advertising objection to us using the contact details given above.
1. Use of your address book, your photos or other data
1) At the beginning of the use of our mobile app, we ask you in a pop-up for permission to use your contacts, your calendar, your reminders, your photos or listed data. If you do not grant permission, we do not use this data. Possibly you cannot use all functions of our mobile app in this case. You can grant or revoke the permission later in the settings of the mobile app of the operating system.
(2) If you allow access to the aforementioned data, the mobile app will only access your data and transmit it to our server insofar as it is necessary for the provision of the functionality. Your data is treated confidentially by us and deleted when you revoke the rights to use or when it is no longer necessary for the provision of services and no legal retention obligations exist.
The legal basis for the processing of the data requested by you through the use of the app functions is Art. 6 para. 1 sentence 1 lit. f GDPR.
2. Collection of your location data
1) Our offer includes so-called location-based services, with which we offer you special offers tailored to your respective location. You can only use these functions after you have consented via a pop-up that we can collect your location data by means of GPS and your IP address in anonymized form for the purpose of service provision. You can allow or revoke the function at any time in the settings of the mobile app or your operating system by calling up under "Settings". Your location is only transmitted to us if you use functions in the mobile app that we can only offer you if we know your location.
(2) For the purposes of analyzing usage, designing the offer according to needs and detecting errors, we create usage profiles if you consent to this when using the mobile app. This data is not merged with other personal data. The legal basis for the processing of the data requested by you through the use of the app functions is Art. 6 para. 1 sentence 1 lit. a GDPR. You can revoke your consent at any time, without affecting the legality of the processing until the revocation. Of course, you can also contact us at office@lifelyfamily.com or the address given in the imprint: https://lifelyfamily.com/imprint.
